These Terms of Service ("Terms") govern your use of ClearCost, an insurance benefit verification and drug cost estimation tool. By creating an account or using our service, you agree to these Terms.

1. Service Description

ClearCost provides medical practices with tools to:

• Verify patient insurance eligibility in real time
• Estimate drug costs based on CMS-published ASP pricing data
• Generate patient cost estimates factoring in deductibles, coinsurance, and copay assistance
• Produce PDF cost estimate documents

2. Estimates, Not Guarantees

ClearCost provides cost estimates only. Estimates are based on data available at the time of the query, including CMS-published ASP pricing and payer-reported eligibility data. Actual patient costs may differ due to:

• Changes in insurance coverage or benefits
• Payer adjudication decisions
• Claim processing variations
• Retroactive benefit changes

ClearCost is not responsible for differences between estimates and actual billed amounts. Users should always confirm coverage details directly with the payer before treatment.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide accurate practice information
• You must not share your account with unauthorized individuals
• The account administrator is responsible for managing team access

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to access other practices' data
• Reverse-engineer, scrape, or redistribute our pricing databases
• Submit false or fraudulent eligibility requests
• Exceed your plan's usage limits through automated or bulk queries

5. Subscription and Billing

• Free trials last 14 days with Starter-tier access
• Paid subscriptions are billed monthly via Stripe
• You may upgrade, downgrade, or cancel at any time
• Downgrades take effect at the next billing cycle
• No refunds for partial months

6. Data and Privacy

Our handling of your data is governed by our Privacy Policy. Key points:

• Patient health information (PHI) is never stored on our servers
• Practice data is isolated via row-level security

7. Availability and Support

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. Enterprise customers receive priority support.

8. Limitation of Liability

To the maximum extent permitted by law, ClearCost shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to incorrect cost estimates, coverage verification errors, or service interruptions.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through Settings or by contacting us. Upon termination, your data will be retained for 30 days and then permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the service after changes constitutes acceptance of the updated Terms.
